The terms and conditions listed below govern the agreement for training services between you and KPME.

 

For services delivered in Dubai, your contract is with:

Kaplan Dubai Limited (Dubai Branch) is registered in Dubai with Trade License number 775174 whose registered office is at Office 20A & 20B, Rolex Tower, Sheikh Zayed Road, P.O. Box 416639, Dubai, UAE.

 

For services delivered in Abu Dhabi your contract is with:

Kaplan Professional ME Limited (Abu Dhabi branch) registered in Abu Dhabi with Trade License number CN-3918299 whose registered office is at 1309 Tamouh Tower, Reem Island, Abu Dhabi, UAE.

Both companies trade as “Kaplan Professional Middle East” or “KPME”.

1. Program

The “Program” refers to any course organized by Kaplan Professional Middle East.

“Student” or “Delegate” refers to a candidate enrolled for any of the Programs with Kaplan Professional Middle East.

With due notice, Kaplan Professional Middle East reserves the right to transfer this training contract to a third-party training provider. In the circumstances of such a transfer, the terms and conditions stated below shall continue to be binding on both parties to the contract.

2. Exclusions

The CFA Institute / IMA / ACCA, GARP and other professional bodies’ enrolment and registration fees are not included in the Program fees. This fee is set by Institutes and payable directly to the relevant bodies.

The cost of study materials may or may not be included in the Program fee, as indicated on your invoice. In cases where it is not included, material may be purchased from Kaplan Professional Middle East where available.

3. Registration Criteria

For all KPME courses, exam registration and study material purchases, enrollment forms are required with a copy of a valid Student’s ID which states nationality.

As Kaplan, Inc. is a US based multinational organisation, we must abide by US, UK & EU trade sanction regulations. Students who enroll for classes are not permitted to attend classes online or use any of Kaplan learning platforms if they change their residence to a sanctioned country or region.

4. Program Schedule

Kaplan Professional Middle East reserves the right to make variations to Program content, dates, venues, and timings if such action is deemed necessary in unforeseen circumstances. Such variations will be communicated to you as soon as reasonably practicable.

Classes are subject to cancellation due to unforeseen circumstances. Any such changes in schedule will be communicated via email or WhatsApp or SMS on the given student’s registered details with Kaplan Professional Middle East.

Students are responsible for regularly checking their registered e-mail address/SMS messages for communications from Kaplan Professional Middle East. Communications will be sent to only one email address provided by the student.

Trainers will be available as scheduled by the Operations team. In no circumstances any trainer be changed to suit the demands of students in the respective batches. Kaplan takes complete authority to place tutors to deliver classes as per availability.

The WhatsApp Group has been initiated to build networking and act as a common study ground where all candidates can learn and grow equally. Any sort of unethical conduct in terms of language, GIFs and use of foreign language except the medium of English or inappropriate language against the Trainers will be taken into serious consideration and Kaplan Professional Middle East reserves the right to terminate the student upon immediate effect.

Students are responsible for notifying us immediately of any change in contact number and/or email address. Kaplan Professional Middle East can only be responsible for classes missed if we are provided with your current contact details in a timely manner.

If a student misses classes, we do not conduct Individual catch-up classes. Students are required to watch the recorded lectures on their learning management system given to them at registration and can approach the trainers for doubt clearing if required.

5. Study Materials

Students will get one copy of the slide handout for each study session/topic. Students who have misplaced or lost their study materials will not be given additional copies. For Students who fail to attend classes, all handouts and other classroom materials will be distributed in the next class.

All study tools purchased and provided during the course are to be used by the registered student only.

All relevant CFA, CMA , ACCA,FRM and CFAB study material purchases must be paid upfront and are non-refundable.

The teaching method and methodologies contained in the material supplied are confidential and proprietary to Kaplan Professional Middle East and are not to be transferred or divulged to any other person by resale of the material or otherwise.

Printed copies of CFA/CMA ACCA,FRM and CFAB Books are not permitted to be brought into class. Students who have selected the Live Online package will not be provided printed study materials, if a student requires there is an additional charge of AED200 which will be added to the invoice to cover the costs of printing and courier charges.

6. Payment terms

The Country of Merchant Domicile is the UAE.

KPME accept payments online using Visa and MasterCard credit/debit cards in AED. All credit/debit card details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties.

If a student is making a payment using a card which is not in his/ her name, they are required to provide an NOC and Passport/Emirates ID copy from the cardholder in order to proceed.

Study materials requires a full upfront payment.

Students may opt to pay in equal instalments – a processing fee of 200 AED will be charged. post-dated cheques will be required for the complete fee. Students will only receive the Study Materials and Online access upon receiving the cheques

  • Initial instalment must be a total of the value of Study Material and Online access granted.
  • Final Instalment must be paid 2 weeks before the course’s end date.
  • We accept payments online using Visa and MasterCard credit/debit cards in AED.

If the cheque name and student name differ a copy of the Passport/ Emirates ID and an NOC from the cheque holder is needed.

If a student wishes to hold back a cheque and pay using a different mode, the cheque holder or the student is responsible to inform the program adviser at least 5 days prior to the deposit date mentioned on the cheque. The same must be communicated in a written email.

Kaplan Professional Middle East DO NOT accept cash payment for any programs, materials or exam bookings.

7. Refund / Deferral Policy

If for any reason the batch is cancelled, a full refund or deferral will be provided.
If a student has deferred once they will not be able to defer or withdraw from the course in future.

Study Material handed over on registration will not be taken back on a request for refund or deferral by the student.

Students who have registered for revision classes are eligible to only defer once to the next subsequent term and are not eligible for cancellation or refund. For a deferral, they must notify a program adviser by email before the start date of the course.

Refunds will be done only through the Original Mode of Payment. The Refund Process will be completed in 30 working days, this excludes Public Holidays.

If for any reason the cardholder has changed his debit/credit card, he or she is solely responsible to notify us. In such a circumstance a bank transfer will be done with a 3% processing fee.

Kaplan Professional Middle East will not be responsible for any delays caused by its intermediary partners during the process of refund.

All associated shipment costs, including duties, customs, and/or brokerage fees, are non-refundable and are the responsibility of the customer.

For CFA

  • A student can defer only once after registration for a valid reason. The deferral will be applicable only to the next subsequent term. The student must inform about his interest to defer in an email and latest by the 4th scheduled class. No refunds or deferrals will be considered on oral communication and post the 4th scheduled class of that course. If a student opts to withdraw, they will receive a program fee refund after deducting the cost of classes (if held already) calculated at AED 300 per class and the cost for Schweser Study Material.at AED 2,645 for level 1, 2,829 AED for level 2, and AED 3,012 for level 3.

For CMA

  • The student can withdraw or defer from the program and receive a program fee refund before the 3rd scheduled class from the date of registration. The student must inform about his interest to defer or refund in an email. The refund will be after deducting the cost of classes (if held already) calculated at AED 300 per class.
    There will be no refunds or deferrals after the 3rd scheduled class from the date of registration.A flat amount of AED 2018 per part is not refundable for Gleim and in-class material handed out at the time of registration.If a candidate registers for both parts at the same time, he must attend classes within one year and notify Kaplan Professional Middle East 2 weeks prior to the course start date for refunds or deferrals.

For ACCA

  • The student can withdraw or defer from the program and receive a program fee refund before the 3rd scheduled class from the date of registration. The student must inform about his interest to defer in an email. The refund will be after deducting the cost of classes (if held already) calculated at AED 300 per class.
    There will be no refunds or deferrals after the 3rd scheduled class from the date of registration.A flat amount of AED 300 per part is not refundable for KAPLAN Study material and in-class material handed out at the time of registration.

    All exemptions and exam fees must be clarified by the student directly from the ACCA Body by reaching out to them on students@accaglobal.com. Kaplan Professional Middle East does not play a part in discussing exemptions and fees relating to the same.
    All General terms and conditions applicable to the self-study program mentioned in the agreement are applicable.

For FRM

  • The student can withdraw or defer from the program and receive a program fee refund before the 3rd scheduled class from the date of registration. The student must inform about his interest to defer in an email. The refund will be after deducting the cost of classes (if held already) calculated at AED 300 per class.
    There will be no refunds or deferrals after the 3rd scheduled class from the date of registration.A flat amount of AED 1560 per part is not refundable for Schweser Study material and in-class material handed out at the time of registration.

For ACE Program

  • No refund if applicable for ACE Program

9. Subscriptions

The subscription courses are a pay as you go method of study where you retain access to study materials for all modules within a qualification until you choose to cancel your subscription. At which point you will have access to the end of your current billing period. At which time access will cease. The available qualification for this is ACCA. Subscriptions can be cancelled through our customer services team.

Free Trial Period

  • To enrol on a Kaplan subscription package, you need to select your preferred subscription payment plan (Quarterly or Annually) and then proceed to checkout. Upon entering payment details, you are formally accepting the Kaplan terms and conditions.
  • You acknowledge the fact that it is your sole responsibility to get registered and/or become a member of the relevant professional accountancy body for your course as required. Kaplan can advise but it is the student’s responsibility to organise this themselves.
  • By enrolling on a Kaplan course, you hereby give Kaplan permission to share your institute registration number with the institute body for the purpose of the result service. You also give permission to the institute to share your exam results with Kaplan. These details will not be shared with any third party.
  • No hard copy materials are provided when enrolling on a subscription course.
  • The Kaplan Integrated Workbook will be downloadable as a PDF for courses. The Study Text and Exam Kit will be available in a soft copy. Pocket Notes/Revision Cards are excluded but can be purchased separately.

Payment

  • Depending on which plan you choose (Quarterly or Annually) charges will vary. You can place your order directly on our website and pay by debit or credit card. You will be asked for your card details at the checkout where you can pay securely. Your order will then take 48 hours to be completed.
  • Kaplan will send you a reminder via email one week before your subscription is set to expire. You can choose to renew your subscription at any time before it expires to ensure uninterrupted access to our services.

Membership

  • If a student decides to cancel their subscription, they are not entitled to a refund for any previous months paid (Quarterly or Annually).
  • If prices increase at any point in the agreement, students will be notified in advance.
  • If a student decides to cancel their subscription, they should contact our customer services team via email.
  • If a student decides to upgrade the subscription they should get in touch with our customer services team via email.

8. LMS Access and WhatsApp groups

For all qualification offered by Kaplan Professional Middle East the LMS access will be valid for two exams sitting. This will only include the recorded lectures, if a student wishes to extend to the third exam window a 15% of the course fee will be applicable to grant extended access provided the student has a valid upcoming exam registration.

Access extension to online study material is available with additional charge based on material provider.

WhatsApp group support for all programs is available for one exam window.

10. Free Re-sit

Based on the following criteria KPME students are eligible to take the class free of charge if they didn’t clear their exam, student will still need to sponsor exam fees on their own.

  • Students must submit the failed result to KPME program advisor via email communication.
  • Students should have appeared for the exam in the same window of their course enrolment.
  • Students must have maintained 85% – 90% attendance during the original course.
  • Students must have maintained active and submitted 80% of progress tests, quiz, during the original course.
  • Free re-sit is not subject to deferral or transfer under any conditions.
  • Students are responsible for any additional fees regarding access extensions or new material.
  • Free Re-sit is for full class enrolment, students registering for OnDemand, tuition only, revision only or ACE program are not eligible for free re-sit.

11. Class Conduct – Rules and Regulations

Students are required to adhere to KPME’s Student Code of Conduct. Students are not allowed to record using any photographic, audio or video device in any Kaplan Professional Middle East Program or part thereof.

Students are requested to switch off their mobile phone or keep it on silent mode once the class has commenced.

Students are requested to assist in ensuring that Kaplan Professional Middle East remains litter free, safe and a healthy working environment.

The classroom and offices of Kaplan Professional Middle East is non-smoking zones.

Kaplan Professional Middle East reserves the right to terminate the program enrolment of any student acting in a manner that impairs, interferes with, or obstructs the orderly conduct, process, or functioning of the program. In such a case, there will be no refund of the program fees.

If students are using the rooms in a third-party venue for self-study, they must abide by the venue’s policies or they may lose the privileges to use these facilities.

12. Termination of Registration

Kaplan Professional Middle East reserves the right to terminate the registration of the Student should he/she fail to comply with these Terms and Conditions or the Code of Conduct referred to above in section 7.

13. Complaints

In the event a Student has a complaint in respect of any of KPME’s services, they may do so in accordance with the Complaints policy found here: KPME_Complaints Policy.pdf.     Complaint Form

14. Personal Injury

    Kaplan Professional Middle East is not responsible for any injury caused by or to the Student or any other person by the Student, nor for the loss or damage to any personal property of the Student or caused by the Student arising from participation in the Program, attendance at Kaplan Professional Middle East’ premises or from the activities of Kaplan Professional Middle East.

The student agrees to participate in the program at his or her own risk and agrees to release Kaplan Professional Middle East, its employees, agents, and contractors from any claim that the student might otherwise be able to make.

15. Limitation on Damages

Kaplan Professional Middle East’s maximum liability relating to services under these terms and conditions shall be limited to the amount paid to Kaplan Professional Middle East by the Student.

16. VAT

    • The company is registered as “Kaplan Dubai Limited (Dubai Branch) ” and Kaplan Professional ME Limited – Abu Dhabi”

 

    • For Dubai and Abu Dhabi branches – Certificate of Tax Group Registration in the United Arab Emirates TRN no is: 100465769600003

 

    • As per the rules & regulations issued by UAE Federal Tax Authority (FTA), companies are required to charge VAT for all goods and services delivered from 1st January 2018.

17. Data Protection

KPME shall process the personal data of a Student in accordance with KPME’s Privacy Policy which can be found at https://kaplanprofessionalme.com/privacy-policy/ as updated from time to time.

18. Compliance with law

      • Kaplan Professional Middle East will not provide any services or products to, nor accept payment from, any country, territory or individual where it would be contrary to law or regulation for Kaplan Professional Middle East to do so.

19. Governing Law and Jurisdiction

      • Any dispute or claim arising out of or in connection with shall be governed and construed in accordance with the laws of the UAE and the courts of Dubai or Abu Dhabi (depending on the place of performance of the services) shall have exclusive jurisdiction.
